THE MAIN PURPOSE OF THE COURSE IS TO PROVIDE STUDENTS WITH A GENERAL AND SYSTEMATIC OVERVIEW OF THE FUNDAMENTAL PRINCIPLES AND MAIN ISSUES OF ITALIAN ADMINISTRATIVE LAW. THE FIRST PART OF THE COURSE WILL DEAL WITH THE LEGAL PROBLEMS OF ADMINISTRATIVE ACTIVITY (I.E. ADMINISTRATIVE PROCEDURE AND DECISIONS). THE SECOND PART, ON THE OTHER HAND, WILL DEAL WITH THE RIGHTS PROTECTION VIS-A-VIS PUBLIC AUTHORITIES AND PROBLEMS OF ADMINISTRATIVE ORGANISATION. IN GENERAL STUDENTS WILL LEARN: TO USE THEORETICAL KNOWLEDGE ABOUT ADMINISTRATIVE LAW IN CONCRETE SITUATIONS, ANALYSING JUDGMENTS AND OTHER LEGAL TEXTS; TO MAKE AUTONOMOUS JUDGMENTS AND TO REFLECT ON THE PRINCIPLE ISSUES OF ADMINISTRATIVE LAW. STUDENTS WILL LEARN HOW TO ORGANIZE THEIR KNOWLEDGE ABOUT ADMINISTRATIVE LAW BOTH IN WRITTEN AND ORAL FORM, WITH THE HELP OF PRESENTATIONS ON SPECIFIC ISSUES. THE COURSE WILL ENABLE STUDENTS TO ANALYSE NEW PROBLEMS IN THIS LEGAL AREA AND TO PERFORM RESEARCHES ALSO ON (NATIONAL AND INTERNATIONAL) DATABASES. |

THE FOLLOWING TOPICS WILL BE COVERED IN THE COURSE OF THE LECTURES: FIRST PART (40 HOURS) - INTRODUCTION: 2 HOURS OF LECTURE - ADMINISTRATIVE ACTIVITY UNDER PUBLIC LAW (ADMINISTRATIVE POWER, LEGITIMATE INTEREST, GENERAL PRINCIPLES, ATYPICAL POWERS): 6 HOURS OF LECTURE - ADMINISTRATIVE PROCEDURE: 7 HOURS OF LECTURE, 2 WRITTEN TEST (FOR ATTENDING STUDENTS), 1 HOUR ANALYSIS OF JUDGMENTS - ADMINISTRATIVE DECISIONS (ADMINISTRATIVE MEASURE, SILENCE CONSENT, SCIA, CONFERENCE OF SERVICES): 8 HOURS OF LECTURE, 1 HOUR ANALYSIS OF JUDGMENTS, 2 WRITTEN TEST (FOR ATTENDING STUDENTS) - EFFECTIVENESS OF THE ADMINISTRATIVE MEASURES: 5 HOURS OF LECTURE - INVALIDITY OF ADMINISTRATIVE MEASURES: 6 HOURS LECTURE, 1 HOUR ANALYSIS OF JUDGMENTS SECOND PART II (40 HOURS) - PROTECTION OF PRIVATE INDIVIDUALS AGAINST PUBLIC AUTHORITIES: 8 HOURS OF LECTURE, 2 WRITTEN TEST (FOR ATTENDING STUDENTS) - LEGAL DATABASES (WORKSHOP): 2 HOURS OF LECTURE - LOCAL SELF-GOVERNMENT: 8 HOURS OF LECTURE, 2 HOURS ANALYSIS OF JUDGMENTS - STATE ADMINISTRATION AND OTHER ORGANISATIONS: 5 HOURS OF LECTURE - INDEPENDENT AUTHORITIES: 3 HOURS OF LECTURE - MICROORGANISATIONS: 4 HOURS OF LECTURE, 1 HOUR ANALYSIS OF JUDGMENTS - PUBLIC EMPLOYMENT: 4 HOURS OF LECTURE, 1 HOUR ANALYSIS OF JUDGMENTS |

THE COURSE CONSISTS OF LECTURES (33 HOURS IN THE FIRST PART AND 32 HOURS IN THE SECOND PART) AND IN-CLASS EXERCISES (2 HOURS FOR EACH PART), WRITTEN TESTS FOR ATTENDING STUDENTS (2 IN THE FIRST PART, 1 IN THE SECOND PART). THE LECTURES ARE AIMED AT EXPOUNDING ON INDIVIDUAL TOPICS, THE IN-CLASS EXERCISES ARE AIMED AT TEACHING STUDENTS TO APPLY THE KNOWLEDGE THEY HAVE LEARNT IN THEORY AND TO MAKE INDEPENDENT JUDGEMENTS ON THE TOPICS ANALYSED, THE WRITTEN TESTS CONSIST OF THREE OPEN-ENDED QUESTIONS AND ARE AIMED AT TESTING THE STUDENTS' PREPARATION ON INDIVIDUAL TOPICS AND THEIR ABILITY TO EXPOUND ON THE KNOWLEDGE THEY HAVE LEARNT. IN THE SECOND PART THERE WILL BE A WORKSHOP (2 HOURS) ON THE MAIN ITALIAN AND INTERNATIONAL LEGAL DATABASES. |

FOR NON-ATTENDING STUDENTS: ORAL TEST. THE TEST IS AIMED AT ASCERTAINING THE CANDIDATE'S LEVEL OF KNOWLEDGE OF THE SUBJECT AND ARGUMENTATION SKILLS. THE TEST CONSISTS OF QUESTIONS ON THE TOPICS DEALT WITH IN “LINEAMENTI DEL DIRITTO AMMINISTRATIVO” AND IN THE DISCUSSION OF JUDGMENTS (CHOSEN BY THE STUDENT: 8 FOR THE FIRST PART, 2 FOR THE SECOND PART) CONTAINED IN THE VOLUME "CASI SCELTI DI DIRITTO AMMINISTRATIVO". WRITTEN INTER-COURSE TESTS (2 IN THE FIRST MODULE, 1 IN THE SECOND MODULE), AS WELL AS A FINAL ORAL TEST, ARE FORESEEN FOR ATTENDED STUDENTS ONLY. THESE TESTS ARE DESIGNED TO VERIFY THE STUDENT'S LEVEL OF KNOWLEDGE OF THE SUBJECT AND ARGUMENTATION SKILLS. |
