KNOWLEDGE AND COMPREHENSION SKILLS. STUDENTS WILL DEVELOP A CONSCIOUS ABILITY TO USE HERMENEUTIC TECHNIQUES AND CRITICAL ANALYSIS OF THE NATIONAL AND EUROPEAN DISCIPLINE THAT REGULATES INSURANCE ACTIVITIES IN ITS VARIOUS ARTICULATIONS, ALSO TAKING INTO ACCOUNT INTERFERENCES WITH BANKING AND SECURITIES MARKET DISCIPLINES. IN THIS WAY, THEY WILL ACQUIRE ADEQUATE CONCEPTUAL TOOLS TO FACE AN ECONOMIC-LEGAL REALITY IN CONSTANT EVOLUTION. ABILITY TO APPLY KNOWLEDGE AND COMPREHENSION. THROUGH THE STUDY OF THE SUBJECT MATTER, STUDENTS WILL REFINE THEIR SENSITIVITY TO THE LEGAL ISSUES UNDERLYING THE EXERCISE OF INSURANCE ACTIVITIES AND DEVELOP COGNITIVE TOOLS FOR IDENTIFYING THE MOST EFFICIENT SOLUTIONS. BY VIRTUE OF THE PROBLEMATIC METHODOLOGICAL APPROACH ACQUIRED, STUDENTS WILL HAVE DEVELOPED INDIVIDUAL CRITICAL SKILLS AND WILL BE ABLE TO VERIFY THAT INSURANCE ACTIVITIES ARE CARRIED OUT IN COMPLIANCE WITH CURRENT REGULATIONS AT EVERY STAGE. - CRITICALLY ANALYZE AND DEEPLY UNDERSTAND INSURANCE CONTRACTS, INSURANCE CONTRACT DISTRIBUTION AND INSURANCE INVESTMENT PRODUCTS - TRAIN STUDENTS, INVOLVING THEM IN PRACTICAL CASES, ON THE MOST RECENT HARD LAW AND CASE LAW IN ORDER TO PREPARE THEM TO THE JOB MARKET |

CONTENT OF THE MODULE: FOUNDATIONS OF INSURANCE LAW IN THE FOUR MAIN FIELDS: (I) INSURANCE COMPANIES, INCLUDING MONITORING AUTHORITIES; (II) INSURANCE CONTRACT AS REGULATED BY THE CIVIL AND THE INSURANCE CODE; (III) DISTRIBUTION OF INSURANCE POLICIES (THROUGH THE BROKERAGE FIRMS); IV) INSURANCE/FINANCIAL PRODUCTS. STRUCTURE OF THE MODULE: INTRODUCTION ON THE HISTORY AND ECONOMICS OF INSURANCE LAW (I) INSURANCE COMPANIES: - REGULATIONS ON INSURANCE COMPANIES; - INSURANCE ACTIVITIES AND COMPANIES; MONITORING; THE IVASS; - CONDITIONS TO ACCESS AND TO EXERCISE INSURANCE ACTIVITIES; FREEDOM OF ESTABLISHMENT AND FREEDOM TO SUPPLY SERVICES WITHIN THE EUROPEAN UNION; - INFRINGEMENT OF PROVISIONS ON THE EXERCISE OF INSURANCE ACTIVITIES; - PORTFOLIO TRANSFER, MERGERS, SPLITTING AND EXTINCTION OF THE INSURANCE COMPANY. (II) THE CONTRACT: - INSURANCE CONTRACT IN GENERAL; DEFINITION, RISK, PRIME, PARTIES, FORMATION AND DURATION OF THE CONTRACT; - THE PROBLEM OF UNFAIR CONTRACT TERMS; - INSURANCES AGAINST DAMAGES; INTEREST AND VALUE; EVENT AND DAMAGE; INSURANCE ON GOODS; INSURANCE ON ASSETS; INSURANCE ON CREDIT; - LIFE INSURANCE; - INSURANCE AGAINST PERSONAL INJURIES; - GLOBAL AND COLLECTIVE SUBSCRIPTIONS POLICIES; - COMPULSORY INSURANCES IN GENERAL; CIVIL LIABILITY INSURANCE; CAR INSURANCE; -REINSURANCE; -TIME LIMITATION. AN EXAMINATION RESULTING IN A SCORE OUT OF 30 ASSESSES THE ACHIEVEMENT OF THE TARGETS OF THE TEACHING’S PROGRAMME. THE ASSESSMENT CONSISTS OF A NON-MANDATORY PROGRESS TEST AND OF AN ORAL EXAMINATION BASED ON TOPICS CHOSEN BY THE PROFESSOR. THE PROGRESS TEST CONSISTS OF SIX WRITTEN MULTIPLE CHOICE QUESTIONS AND OF TWO WRITTEN OPEN-ENDED QUESTION. THE ORAL EXAMINATION TAKES PLACE ACCORDING TO THE DATES OF THE RELEVANT CALENDAR. THE TOTAL SCORE (30/30) OF THE PROGRESS TEST CONSISTS: OF THREE POINTS FOR EACH MULTIPLE CHOICE CORRECT ANSWER AND OF ZERO FOR EACH MISTAKE OR NOT GIVEN ANSWER; AND OF A SCORE BETWEEN ZERO AND 6 FOR THE OPEN-ENDED QUESTION, ACCORDING TO THE FOLLOWING JUDGMENTS: GRAVELY INSUFFICIENT; INSUFFICIENT; SUFFICIENT; FAIR; AND GOOD. THE ORAL EXAMINATION OF THE STUDENT IS ASSESSED WITHIN A SCALE OF MARKS OUT OF 30 AND IT IS PASSED FROM 18/30, ACCORDING TO THE FOLLOWING JUDGMENTS: GRAVELY INSUFFICIENT; INSUFFICIENT; SUFFICIENT; FAIR; AND GOOD. THE PROGRESS TEST AND THE ORAL EXAMINATION AIM AT ASSESSING: THE LEVEL OF UNDERSTANDING AND KNOWLEDGE ACHIEVED BY THE STUDENTS CONCERNING THE CONTENT OF THE PROGRAM; THE COMMAND OF METHODOLOGICAL INSTRUMENTS; AND THE CAPACITY OF APPLYING KNOWLEDGE TO THE SOLUTION OF THEORETICAL AND PRACTICAL PROBLEMS. FINAL EVALUATION RESULTS FROM THE AVERAGE OF THE SCORES ACHIEVED IN THE PROGRESS TEST AND THE ORAL EXAMINATION. IF THE STUDENT DECLINES THE PROGRESS TEST’S SCORE, THE ORAL EXAMINATION SHALL COVER ALL THE AFOREMENTIONED TOPICS, AND IT IS SUCCESSFUL WHEN THE MINIMUM SCORE OF 18/30 IS ACHIEVED. |
