Objectives
KNOWLEDGE AND UNDERSTANDING

THE COURSE AIMS TO PROVIDE A SYSTEMATIC FRAMEWORK OF THE REGULATION OF LABOR LAW, WITH SPECIFIC REFERENCE TO THE TOURISM SECTOR. STUDENTS WILL ACQUIRE THE FUNDAMENTALS OF LABOR LAW IN THE PRIVATE SECTOR, STUDYING THE MAIN ISSUES AND MECHANISMS THAT GOVERN THE EMPLOYMENT RELATIONSHIP, AS WELL AS THE CRUCIAL ASPECTS RELATED TO COLLECTIVE BARGAINING. MEANINGWHILE, THE AFOREMENTIONED PRINCIPLES AND RULES WILL BE APPLIED TO THE STUDY OF THE NATIONAL COLLECTIVE AGREEMENT (SO CALLED CCNL) APPLICABLE TO TOURISM SECTORS.

APPLYING KNOWLEDGE AND UNDERSTANDING

AT THE END OF THE COURSE, STUDENTS WILL HAVE ACQUIRED A TECHNICAL LANGUAGE, AND AN ADEQUATE KNOWLEDGE OF GENERAL PRINCIPLES AS WELL AS SPECIFIC REGULATIONS OF LABOR LAW, AND WILL BE ABLE TO CRITICALLY ANALYZE SPECIFIC ISSUES RELATED TO THE TOURISM SECTORS.
Prerequisites
A BASIC KNOWLEDGE OF THE MAIN RULES GOVERNING OBLIGATIONS AND CONTRACTS IS REQUIRED, AS WELL AS OF PRESCRIPTION AND LIMITATION PERIOD.

THE COURSE CONTENTS CAN BE DIVIDED INTO FOUR AREAS:
A. HISTORICAL EVOLUTION OF LABOR LAW, SOURCES, LABOR MARKET AND PLACEMENT.
B. THE INDIVIDUAL WORK RELATIONSHIP: NATURE AND CONSTITUTION OF THE EMPLOYMENT RELATIONSHIP, DISTINCTION BETWEEN SELF-EMPLOYED, SUBORDINATED, AND PARASUBORDINATED WORK; OBLIGATIONS OF THE EMPLOYEE (IN PARTICULAR, DILIGENCE AND LOYALTY); EMPLOYER OBLIGATIONS (IN PARTICULAR, SALARY AND SAFETY OBLIGATION); PROFESSIONAL CLASSIFICATION AND DUTIES OF THE WORKER; THE REGULATION OF WORKING TIME; CONTRACTS WITH TRAINING CONTENT, PARTICULARLY APPRENTICESHIP; EMPLOYER POWERS (MANAGEMENT, CONTROL, DISCIPLINARY, WITH PARTICULAR ATTENTION TO DISMISSAL).
C. FLEXIBILITY AND OUTSOURCING: FIXED-TERM CONTRACT; PART-TIME; OCCASIONAL JOB; JOB-ON-CALL; SEASONAL WORK; SMARTWORK; PLATFORM WORK; TEMPORARY AGENCY WORK AND STAFF LEASING; COMPANY TRANSFER.
D. TRADE UNION RELATIONS: CONSTITUTIONAL PRINCIPLES; COLLECTIVE BARGAINING; RSA AND RSU; TRADE UNION RIGHTS AND REPRESSION OF ANTI-TRADE UNION CONDUCT; THE RIGHT TO STRIKE. COLLECTIVE AGREEMENT AND CORPORATE WELFARE.

THE TOPICS WILL BE TREATED BY COMPARING THE REGULATORY STATEMENT AND THE JURISPRUDENTIAL APPROACH, ALSO PAYING ATTENTION TO THE SPECIFIC NATIONAL CONTRACT (CCNL) APPLICABLE TO TOURISM SECTOR.

FRONTAL LESSONS AND, WHERE PROVIDED, IN-DEPTH SEMINARS.
Verification of learning
THE EVALUATION OF THE ACQUIRED KNOWLEDGE WILL TAKE PLACE THROUGH AN ORAL EXAM TO BE HELD ON THE SCHEDULED DATES, WHICH WILL ALSO TAKE ACCOUNT OF THE STUDENT'S CRITICAL SKILLS AND LANGUAGE PROFICIENCY. THE FINAL MARK WILL BE EXPRESSED IN THIRTIETHS, FROM A MINIMUM OF 18/30, REQUIRED FOR PASSING THE EXAM, TO A MAXIMUM OF 30/30, WITH POSSIBLE ADDITIONAL HONORS.

FOR STUDENTS FOLLOWING FRONTAL LESSONS IT IS POSSIBLE TO SCHEDULE A WRITTEN EXAM TAKING PLACE ON THE FIRST CALENDAR EXAM DATE, CONSISTING OF 30 MULTIPLE CHOICE QUESTIONS TO BE COMPLETED IN 45 MINUTES. EACH QUESTION CORRESPONDS TO 1 POINT.
THE FINAL EVALUATION FOLLOWS THE ORAL ONE: FROM A MINIMUM OF 18/30 TO A MAXIMUM OF 30/30.
